ServiLynk Terms of Service

(Applicable to Customers, Service Providers, Visitors, and Users of the ServiLynk Platform)

(Aligned with the laws of the Republic of Ghana, including the Ghana Data Protection Act, 2012 (Act 843) and applicable electronic transaction, consumer protection, and contractual principles)

1. Introduction

Welcome to ServiLynk.

ServiLynk is a technology-enabled digital marketplace platform that connects customers with independent service providers, professionals, artisans, contractors, and businesses across multiple service categories.

These Terms of Service (“Terms”) govern access to and use of the ServiLynk website, mobile applications, customer and provider accounts, digital tools and communication systems, booking, payment, and support services, and related platform services operated by ServiLynk.

By accessing or using ServiLynk, users agree to comply with these Terms and all related policies referenced herein.

If a user does not agree to these Terms, the user must discontinue use of the platform.


2. Definitions

For purposes of these Terms:

“ServiLynk” refers to the ServiLynk platform, its operators, affiliates, employees, representatives, and authorized agents.

“Customer” means any person or entity requesting, booking, purchasing, or receiving services through the platform.

“Service Provider” means any independent contractor, artisan, technician, consultant, vendor, business, or professional offering services through ServiLynk.

“Platform” means the ServiLynk website, applications, systems, and digital services.

“Booking” means a confirmed service request made through the platform.

“Content” includes text, images, reviews, messages, ratings, videos, logos, and digital materials.

“User” means any visitor, customer, or service provider accessing the platform.


3. Acceptance of Terms

By creating an account, accessing, browsing, or using the platform, users confirm that they have read and understood these Terms, agree to be legally bound by these Terms, consent to applicable policies referenced by ServiLynk, and agree to comply with applicable laws and regulations in Ghana.

Electronic acceptance of these Terms constitutes a legally binding agreement.


4. Eligibility

To use ServiLynk, users must:

Be at least 18 years old or the age of legal contractual capacity under Ghanaian law.

Provide accurate and complete registration information.

Use the platform lawfully and responsibly.

Not be prohibited from using digital or payment services under applicable laws.

ServiLynk reserves the right to refuse or restrict access where eligibility requirements are not met.


5. User Accounts

Users may be required to create accounts to access certain platform services.

Users are responsible for maintaining account confidentiality, securing passwords and login credentials, restricting unauthorized account access, and ensuring information remains accurate and updated.

Users must immediately notify ServiLynk of suspected unauthorized account activity.

ServiLynk shall not be liable for losses arising from unauthorized account use resulting from user negligence or security failures outside ServiLynk’s reasonable control.


6. Service Provider Obligations

Service Providers using ServiLynk agree to provide lawful, safe, and professional services; maintain required licenses, certifications, permits, and registrations where applicable; provide accurate profile and business information; deliver services consistent with agreed scope and quality standards; comply with health, safety, tax, labor, and regulatory obligations; avoid misleading advertising or deceptive practices; respect customer privacy and property; and comply with ServiLynk onboarding, verification, and compliance procedures.

Service Providers are independent contractors and not employees, partners, agents, or representatives of ServiLynk unless expressly stated otherwise.


7. Customer Obligations

Customers agree to provide accurate booking information, treat service providers respectfully and lawfully, provide reasonable access necessary for service delivery, make payments when due, avoid fraudulent, abusive, unsafe, or unlawful conduct, and use the platform only for legitimate service-related purposes.

Customers shall not misuse platform systems, provider information, or communication tools.


8. Booking and Payments

ServiLynk facilitates digital booking and payment processing between customers and service providers.

Prices displayed on the platform may include fixed pricing, estimated pricing, scope-based pricing, hourly rates, inspection or quotation fees, and dynamic or distance-based pricing.

Final pricing may vary depending on scope changes, materials, additional labor, time requirements, site conditions, and customer-approved modifications.

Payments may be processed through Mobile Money services, debit or credit cards, bank transfers, digital wallets, and approved payment gateways.

Users authorize ServiLynk and its payment partners to process payments associated with confirmed transactions.


9. Cancellations and Refunds

Bookings may be cancelled subject to applicable cancellation timelines and operational conditions.

Refund eligibility shall be governed by the ServiLynk Refund Policy.

ServiLynk reserves the right to decline invalid refund requests, investigate disputed transactions, apply cancellation charges where appropriate, and issue refunds, credits, or alternative compensation arrangements where justified.


10. Platform Rules and Acceptable Use

Users shall not violate applicable laws, submit false or misleading information, engage in fraud or payment abuse, harass, threaten, or discriminate against others, upload malicious software or harmful code, attempt unauthorized access to platform systems, use automated scraping or unauthorized data extraction tools, circumvent platform processes or fees, or use the platform for illegal, unsafe, or prohibited activities.

ServiLynk may investigate suspected violations and take appropriate action.


11. Prohibited Conduct

The following activities are strictly prohibited:

Fraudulent bookings or payments.

Identity theft or impersonation.

Money laundering or suspicious financial activity.

Distribution of harmful, offensive, or unlawful content.

Unsafe, abusive, violent, or discriminatory behavior.

Unauthorized commercial solicitation.

Circumvention of safety or verification procedures.

ServiLynk reserves the right to cooperate with regulatory, law enforcement, or financial authorities where unlawful conduct is suspected.


12. Ratings and Reviews

Customers may provide ratings, reviews, or feedback regarding service experiences.

Users agree that reviews must be truthful and accurate, must not contain defamatory, abusive, or misleading statements, and must not violate third-party rights or laws.

ServiLynk reserves the right to moderate, remove, or restrict content that violates these Terms or platform standards.


13. Intellectual Property

All platform-related intellectual property including logos, branding, software, designs, content, graphics, text, and platform functionality remain the property of ServiLynk or its licensors unless otherwise stated.

Users may not reproduce, distribute, modify, reverse engineer, or commercially exploit platform materials without prior written authorization.


14. Privacy and Data Protection

ServiLynk processes personal data in accordance with the ServiLynk Privacy Policy, the ServiLynk Cookies Policy, and the Ghana Data Protection Act, 2012 (Act 843).

Users consent to the collection, processing, storage, transfer, and use of personal data necessary for lawful platform operations, customer support, fraud prevention, security, and regulatory compliance.


15. Third-Party Services

ServiLynk may integrate or rely on third-party providers for payment processing, cloud hosting, analytics, messaging services, security systems, and external tools or integrations.

ServiLynk does not control third-party systems and shall not be responsible for losses arising solely from third-party failures outside its reasonable control.


16. Marketplace Disclaimer

ServiLynk operates primarily as a technology marketplace platform connecting customers with independent service providers.

Unless expressly stated otherwise, ServiLynk does not directly provide most listed services, Service Providers are independent contractors, ServiLynk does not guarantee the quality, legality, suitability, licensing, availability, or performance of every provider or service, and service outcomes may vary depending on provider capability, customer cooperation, and external conditions.

ServiLynk may conduct onboarding, verification, screening, or compliance checks but such checks do not constitute guarantees or warranties.

Users engage providers at their own discretion and risk subject to applicable laws.


17. Limitation of Liability

To the maximum extent permitted by applicable law, ServiLynk shall not be liable for indirect or consequential damages, loss of profits or revenue, business interruption, property damage caused by independent providers, personal injury arising from third-party conduct, delays caused by external systems or events, losses arising from user negligence or misuse, or actions or omissions of independent service providers.

Nothing in these Terms excludes liability that cannot legally be excluded under Ghanaian law.


18. Indemnity

Users agree to indemnify and hold harmless ServiLynk, its affiliates, officers, employees, and agents from claims, liabilities, losses, damages, costs, or expenses arising from user misconduct, violation of these Terms, breach of applicable laws, fraudulent activities, infringement of third-party rights, or unsafe or unlawful conduct.


19. Suspension and Termination

ServiLynk reserves the right to suspend, restrict, or terminate accounts where users violate these Terms, engage in suspicious or unlawful activities, pose safety, compliance, reputational, or operational risks, abuse platform systems or refund processes, or fail to comply with verification requirements.

Termination may occur with or without prior notice depending on the severity of the issue.


20. Force Majeure

ServiLynk shall not be liable for delays, failures, or disruptions caused by events beyond its reasonable control including power outages, internet disruptions, cybersecurity incidents, regulatory actions, natural disasters, civil unrest, telecommunications failures, and banking or Mobile Money service interruptions.


21. Dispute Resolution

Users are encouraged to first seek amicable resolution through ServiLynk customer support and internal complaint handling procedures.

Disputes may subsequently be resolved through negotiation, mediation, Alternative Dispute Resolution (ADR), or courts of competent jurisdiction in Ghana.


22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Ghana.

Any disputes arising from or relating to these Terms shall fall within the jurisdiction of competent courts and dispute resolution mechanisms in Ghana.


23. Amendments to Terms

ServiLynk reserves the right to amend or update these Terms periodically to reflect legal developments, operational changes, technology updates, security improvements, and platform enhancements.

Updated versions may become effective upon publication through official ServiLynk communication channels.

Continued use of the platform after updates constitutes acceptance of revised Terms.
